Despite the legislation protecting intellectual property and other copyrighted material, there are exceptions allowing these materials to be used without violating law. These exceptions include fair use and the TEACH Act, and are important considerations for using copyrighted material. <\/p>\n\n\n\n

The concept \u201cfair use\u201d in\u00a0U.S. Code Title 17, Section 107<\/a>\u00a0permits certain uses of copyright works without needing permission from the copyright holder.<\/p>\n\n\n\n

Section 107 states: \u201cNotwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.\u201d <\/p>\n<\/div><\/div>\n<\/div>\n\n\n\n

            How Do I know if it is Fair Use?<\/a><\/h4><\/div>

            No single factor determines whether something is fair use. All four factors must be considered in determining whether or not a use is fair. It is important to be able to explain your analysis of these factors if your use is later challenged. <\/p>\n\n\n\n
